Terms and Conditions

 Terms and Conditions of Services Effective 11.04.2025. Clear Dog Training, hereafter referred to as “Clear Dog Training”, “we”, “our” or “us”, is a one-person entity that provides dog related services of 1 to 1 dog and puppy training, group classes, workshops and training sessions, collectively known as the “service(s)”, “session(s)” or “booking(s)”. The “client(s)”, “owner(s)”, “handler(s)” refers to the person filling out the enrolment form and anyone affiliated with or responsible for the dog that attends a training session or class, be that in person or via video call.

In the interests of safety to CLEAR DOG TRAINING, volunteers, clients, handlers, attendees and spectators please read and agree to the following conditions. This declaration sets out the terms in which CLEAR DOG TRAINING accepts a client onto any session. When the client agrees to this declaration, they will be bound by CLEAR DOG TRAINING’s Terms and Conditions. CLEAR DOG TRAINING reviews and changes these conditions from time to time in order to assist the proper delivery of services and education. CLEAR DOG TRAINING reserves the right to introduce changes at any time when it is in the interest of clients, handlers, CLEAR DOG TRAINING, volunteers and dogs.

BOOKINGS AND PAYMENT

 1. All fees must be paid at the time of booking prior to the service commencing. A booking cannot be made or confirmed without full payment. No service shall be provided until payment is made. 

2. Fees are as set out in written communication with you and are quoted per dog. VAT is not chargeable.

3. Fees are exclusive of any out-of-pocket expenses. Any such expenses will be agreed with you in advance of being incurred.

4. Bookings can only be made by telephone (07789 884388) or email (info@cleardogtraining.co.uk). Payments must be made in full by electronic bank transfer, using the details provided at the time of booking. An electronic receipt will be issued where requested in writing. Cash payments are not accepted. Payment details are provided at the bottom of invoices for service at the time of booking. If payment is not received in full, CLEAR DOG TRAINING reserves the right to cancel the Session.

5. All payments are processed in British Sterling (GBP) at the time of payment. CLEAR DOG TRAINING is not responsible for any fees, charges, exchange rates or additional charges levied by the individual financial institutions or credit card companies.

6. All 1 to 1 training sessions as part of a programme or package must be booked in straight away once you have paid. This is to ensure continuity in your training and to avoid the disappointment of long breaks between sessions. The frequency of the sessions will be decided between the client and CLEAR DOG TRAINING.

7. All 1 to 1 bookings of multiple of sessions must be completed within a set time period to ensure continuity and momentum in training. 

8. A Consultation Call is required prior to confirming a booking and will be booked at a mutually convenient time prior to the first training session.

RESCHEDULING OF TRAINING SESSIONS

1. CLEAR DOG TRAINING is an appointments-based business and cannot function at the high professional standard that we strive for with repeated rescheduling of sessions from clients. However, CLEAR DOG TRAINING appreciates that life events and circumstances outside of the client’s control can happen and we aim to be flexible within reason, within the limits of our business hours and the terms and conditions stated here.

2. CLEAR DOG TRAINING permits the following number of rescheduled sessions per booking. Upon reaching the limits stated below, the client will lose any further sessions they require to be rescheduled, and no refund shall be given.

- Single 1 hr session can be rescheduled only once

- Block of 5 sessions permits a maximum of 2 rescheduled sessions

3. Any further requests for sessions to be rescheduled beyond the limits stated above will only be granted at the discretion of CLEAR DOG TRAINING.

4. If the client becomes unavailable for the original date and time of their booking they must give CLEAR DOG TRAINING at least 48 hours notice, and the booking will be rescheduled for a mutually convenient time. If less than 48 hours notice is given the client will lose the session.

CANCELLATIONS AND REFUNDS

1. Subject to any statutory rights of cancellation, payments for 1 to 1 training, classes, workshops, events, membership fees or gift certificates are non-refundable and non-transferable unless otherwise stated in these Terms and Conditions. Refunds, if any, shall be made entirely at CLEAR DOG TRAINING’s discretion.

2. If your booking is made within 14 days of the service then you agree to waive your right to rely upon the 14-day statutory cooling off and cancellation period.

3. If the client moves outside CLEAR DOG TRAINING’s service area before, or once 1 to 1 training has commenced, a refund will not be given. The option to complete the sessions via zoom will be offered.

4. If the client fails to attend a 1 to 1 session or class no refund shall be given.

5. If the client is more than 20 minutes late for a 1 to 1 training session and has not corresponded with CLEAR DOG TRAINING to inform them of the delay, the session will be cancelled, and no refund shall be given.

6. No refunds will be given if a client decides not to use the full number of sessions from a purchased programme or class.

7. No refunds will be given if a client withdraws from a class before their start date. If the space on the course can be filled, then credit of the course price will be given to the client to use for an additional purchase from CLEAR DOG TRAINING.

8. No refunds will be given for missed classes, nor can clients attend classes beyond the designated timetable they booked on to.

9. CLEAR DOG TRAINING reserves the right to terminate the contract (at any time, with immediate effect) if any dog under the contract does not respond well to the training plan. This includes, but not limited to, dogs that are not comfortable in a class environment. In this case, partial refunds will apply.

10. CLEAR DOG TRAINING reserves the right to terminate the contract at any time and with immediate effect if the client or anyone with their dog is abusive towards any CLEAR DOG TRAINING staff or volunteers. No refund shall be given.

11. If a client is non-compliant or withholding information with regards to the behaviour of their dog(s), including but not limited to aggression, which could compromise the safety of CLEAR DOG TRAINING staff or volunteers then the contract will be terminated immediately, and no refund given.

12. Refunds, if any, shall be made entirely at CLEAR DOG TRAINING’s discretion. 

13. Any refunds granted at the discretion of CLEAR DOG TRAINING. Where a refund is issued, it will be made by bank transfer to the person who made the original payment. Refunds can take up to seven working days to appear in the client’s account.

GENERAL

1. Our methods are kind, ethical and effective. However, instant results are unlikely, and training will take long term commitment from the client to work with their dog throughout the duration of the booked sessions and beyond. It is the responsibility of the client to practice the training recommended by CLEAR DOG TRAINING to achieve the desired results. The training that I use will be tailored for your dog based on the information you provide to me, including via the Consultation Call.

2. Dogs must be kept on leads at all times, unless otherwise directed by CLEAR DOG TRAINING.

3. If your bitch is in season please inform CLEAR DOG TRAINING as soon as possible to discuss whether it’s appropriate for your dog to do 1 to 1 training during this time.

4. Bitches in season are not permitted to attend classes or workshops due to the level of distraction this will create for other dogs.

5. Aggression or behaviour issues must be declared during the Consultation Call before training begins. CLEAR DOG TRAINING reserves the right to refuse to engage in training based on information given during the Consultation Call or during a training session.

6. I train using positive reinforcement methods as I believe it is the most effective way to train dogs. If you use forceful handling methods or punishment, your Session will be terminated, and you will not be offered a refund.

7. I will not conduct a training Session where aversive equipment is being used. This includes but is not limited to choke chains, prong collars, electric collars, rattle cans and corrector spray. These Sessions will be cancelled, and you will not be offered a refund. 

HEALTH AND SAFETY

1. Clients must follow the instructions of the trainer at all times.

2. CLEAR DOG TRAINING cannot be held liable for any losses of any kind that arise from this contract, or the provision of our services save for death or personal injury caused by negligence. This clause does not attempt to avoid any liability which cannot be excluded by law.

3. CLEAR DOG TRAINING accepts no responsibility for any damage to, theft of, or from your vehicle. Please do not leave valuables in your car.

4. Clients are responsible to ensure their dog is fit and healthy to attend training. Your dog must be fully vaccinated and on a regular flea and worm control regime. You will provide proof of vaccinations upon request. You are fully responsible for the good health and timely vaccination status of your dog and will seek professional medical assistance from your veterinarian. The Trainer is not qualified to provide any medical or vaccination advice. 

5. Dogs who are ill, injured or post operation are not allowed to attend class until full recovered. However, it is advisable that the client attends the session on their own so they can continue the training at home.

6. CLEAR DOG TRAINING will apply personal judgement and cut short a training session, if necessary, because of extreme weather conditions and other factors; including, but not limited to excessive heat, rain, thunderstorms and snow/ice. The decision to do so lays with the judgement of CLEAR DOG TRAINING, for the safety of themselves, the client and client’s dog, members of the public, and other animals. In such circumstances the booking will be rearranged for a mutually convenient time.

7. Should training sessions have to be cancelled due to changes relating to Covid-19 (including but not limited to a lockdown or rules about 1 to 1 or group gatherings changing) a refund will not be given, the training session will either be rearranged for a mutually convenient time and date or carried out virtually via Zoom. This is at the discretion of CLEAR DOG TRAINING. W will adhere to the safety measures advised by the UK governing body at the time of the session.

8. CLEAR DOG TRAINING will apply personal judgement and cut short a training session, if necessary, if we feel the dog is not coping well.

9. Dogs must be kept under control when CLEAR DOG TRAINING is entering your home. Failure to do so and any injury caused by your dog being out of control will be your full responsibility. Where appropriate and directed by us, we will meet outside your home first and in some instances, we may work only outside taking a hands-off approach working at a distance (especially in the case of anxious dogs).

10. You will be responsible for keeping your dog a sufficient and safe distance from people and dogs, and under control.

11. In the case of behavioural issues, you agree to give consent to work with us and are happy for us to contact your vet on your behalf should this be necessary.

CLIENT RESPONSIBILITIES

1. It is your responsibility to fully and honestly complete the Consultation Call at least 72 hours in advance of your Session. The Trainer accepts no responsibility for matters not disclosed during the Consultation Call. The Session will not proceed without the Consultation Call having been completed. 

2. You will inform the Trainer before any Training Session regarding any updates to the information previously provided in the Consultation Call. This includes but is not limited to medical information, dog behavioural changes, homing situation or ownership of the dog and legal matters relating to the dog for example a Court order.

3. You confirm that the dog is not subject to the Dangerous Dog Act 1991, is not subject to a Court Order and is lawfully in your care.

4. Your dog must be fully vaccinated and on a regular flea and worm control regime. You will provide proof of vaccinations upon request. You are fully responsible for the good health and timely vaccination status of your dog and will seek professional medical assistance from your veterinarian. The Trainer is not qualified to provide any medical or vaccination advice. 

5. The training that we provide will be specific to the dog that you have consulted us on. It is not designed for, and should not be used for, any other dogs without prior consultation with us regarding its relevance. 

6. It is your responsibility to keep yourself, your family and visitors, and your dog safe. I am not responsible for injuries or damage to you, your dog or personal property. Your dog must be kept on a lead during training unless agreed with the Trainer.

7. You are responsible for all vet bills, no matter how they are incurred.

8. You must keep your dog under control during the Session. Failure to do so and any injury caused by your dog being out of control will be your full responsibility.

9. You are responsible for bringing any recommended equipment advised by the Trainer to the Session. 

10. You will ensure your dog has a well-fitted and secure flat collar or harness with an ID tag.

11. You will ensure that your dog is microchipped and registered in line with UK Dog Laws.

12. If your dog is known to bite other dogs or cause injury then they must wear a well-fitting muzzle for the Session. The Trainer takes no responsibility for dogs not muzzled or not kept under control during the Session or when outside of the Session. Failure to wear a muzzle when asked may result in the immediate termination of services.

13. You are happy for CLEAR DOG TRAINING to share success stories about your dog via social media, and share photos and videos taken during our session(s).

14. You will inform CLEAR DOG TRAINING before the Session if you have tested positive for Covid-19 on the day of the Session or in the 5 days prior to the Session.

PRIVACY

  • We respect your privacy in accordance with the GDPR and you confirm agreement to the same regarding CLEAR DOG TRAINING’s information.
  • You agree that you will not share or transfer training materials provided to you by CLEAR DOG TRAINING as part of the Services to any other persons, apart from individuals involved in the training of the dog for whom they were provided. 
  • CLEAR DOG TRAINING collects information from and about their clients and their dogs for the sole purpose of providing their Services and may disclose this information to      others as is necessary for the provision of said Services. This includes but is not limited to veterinarians with whom the Trainer would be reasonably expected to share information in the provision of Services. The Trainer shall accept no liability for any loss or inconvenience suffered by any party as a result of the disclosure of such information. 

GOVERNING LAW & JURSIDICTION

These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the law of England & Wales.
 

Each party agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement.
